One-Year Premium Parts and Labor Warranty

1. Definition of Terms

In this warranty policy, the following terms are defined as follows:

- **"Product"**: Refers to any hardware manufactured for or by M-Tech that bears the "M-Tech" trademark, trade name, or logo and is purchased directly from M-Tech or an Authorized Reseller.

- **"Original Purchaser"**: Any consumer who buys and possesses a Product directly from M-Tech or an Authorized Reseller.

- **"Authorized Reseller"**: A retail store that has an ongoing agreement to purchase Products directly from M-Tech for resale.

- **"End User"**: The ultimate consumer of the Product, which includes anyone who owns and uses an M-Tech Product.

- **"Date of Original Retail Purchase"**: The date the Original Purchaser bought the Product from M-Tech or an Authorized Reseller.

2. Scope of Warranty

M-TECH WARRANTS that this M-Tech hardware Product is free from defects in materials and workmanship for a period of ONE (1) YEAR from the Date of Original Retail Purchase.

a. Products Covered

This warranty applies only to hardware Products manufactured by or for M-Tech that can be identified by the "M-Tech" trademark, trade name, or logo affixed to them. M-Tech does not provide any warranty for software included with its Products; such software is warranted separately by its manufacturers. Additionally, this warranty does not apply to products that are not M-Tech Products. The warranty is void if:

1. The Product has been damaged due to accident, abuse, misuse, or misapplication.
2. The Product has been modified without written permission from M-Tech.
3. The M-Tech serial number has been removed or defaced.

b. Service Procedures

If you discover a defect, M-Tech will, at its discretion and to the extent permitted by law:

1. Repair the Product using new or refurbished replacement parts.
2. Replace the Product with one that is new or manufactured from new or serviceable used parts that is at least functionally equivalent to the original product.
3. Refund the purchase price of the Product at no charge, provided it is returned during the limited warranty period, with freight charges prepaid to the appropriate M-Tech repair department, and after obtaining a Return Merchandise Authorization (RMA) number prior to shipping the defective Product. The RMA number must be clearly marked on the outside of the shipping package. RMA numbers can be obtained by contacting M-Tech at the address and phone numbers printed on this certificate. When returning a Product for warranty service, please include your name, address, telephone number, RMA number, and a copy of your bill of sale with the relevant M-Tech serial numbers as proof of the Date of Original Retail Purchase.

It is your responsibility to back up all data and programs on M-Tech Products prior to returning the Product for warranty repair. M-TECH IS NOT LIABLE FOR LOSS OR RECOVERY OF DATA OR PROGRAMS.

M-Tech will cover UPS ground shipping for both directions for returned products, applicable only to END USERS in the CONTINENTAL UNITED STATES (excluding Puerto Rico, Alaska, Hawaii, and U.S. territories). If you are outside this area, you are responsible for shipping the product to our repair facility, and we will return it to you freight collect. M-TECH CAN ONLY PROVIDE RETURN SHIPPING TO END USERS WITH AN FPO/APO ADDRESS.

M-TECH RESERVES THE RIGHT TO REQUIRE REIMBURSEMENT FOR SHIPPING COSTS IF IT IS OBVIOUS THAT THE ISSUE IS NOT COVERED BY THIS LIMITED PARTS AND LABOR WARRANTY.

c. Lifetime Free Technical Support

M-TECH WILL PROVIDE telephone or email technical support to the ORIGINAL PURCHASER of an M-Tech Product for as long as the Original Purchaser continues to possess the Product. Support for all "Third-Party" software and peripherals comes from their respective original manufacturers and is not covered by this Lifetime Free Technical Support.

3. Limited Warranty Obligations

TO THE EXTENT PERMITTED BY LAW, THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHERS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS, OR IMPLIED. M-TECH SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. IF M-TECH CANNOT LAWFULLY DISCLAIM STATUTORY OR IMPLIED WARRANTIES, THEN, TO THE EXTENT PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS EXPRESS WARRANTY AND TO REPAIR OR REPLACEMENT SERVICE AS DETERMINED BY M-TECH IN ITS SOLE DISCRETION.

No M-Tech dealer, agent, or employee is authorized to make any modifications, extensions, or additions to this warranty. If any term is found to be illegal or unenforceable, the legality or enforceability of the remaining terms will not be affected or impaired.

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE EXTENT PERMITTED BY LAW, M-TECH IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
